Los reg\u00edmenes aduaneros, seg\u00fan establece la Ley Aduanera, son el conjunto de operaciones que buscan dar un destino aduanero espec\u00edfico (un lugar y un prop\u00f3sito claros) a una mercanc\u00eda. Establecen normas generales, permiten el control aduanero de la mercanc\u00eda que entra o sale del pa\u00eds, y proveen a las aduanas de una clasificaci\u00f3n universal, optimizando los mecanismos y eficientizando los procesos de comercio exterior.\u00a0<\/span><\/p>\n<p><span style=\"\\\"font-weight:\" 400;\\\">La Ley Aduanera, a su vez, regula el uso de espacios destinados, espec\u00edficamente, a la realizaci\u00f3n de actividades de comercio exterior. Es decir, mientras que los reg\u00edmenes aduaneros determinan la naturaleza y especificaciones de las actividades, los dep\u00f3sitos fiscales, <\/span><b>recintos fiscales <\/b><span style=\"\\\"font-weight:\" 400;\\\">y <\/span><b>recintos fiscalizados<\/b><span style=\"\\\"font-weight:\" 400;\\\"> son los espacios en los que se llevar\u00e1n a cabo.\u00a0<\/span><\/p>\n<p><span style=\"\\\"font-weight:\" 400;\\\">A lo largo de esta entrada, exploraremos estos dos \u00faltimos sitios: <\/span><b>recinto fiscal<\/b><span style=\"\\\"font-weight:\" 400;\\\"> y <\/span><b>recinto fiscalizado<\/b><span style=\"\\\"font-weight:\" 400;\\\">.\u00a0<\/span><\/p>\n<p><b>Tambi\u00e9n te puede interesar<\/b><span style=\"\\\"font-weight:\" 400;\\\">:\u00a0<\/span><\/p>\n<h2><b>Recinto fiscal y Recinto fiscalizado<\/b><span style=\"\\\"font-weight:\" 400;\\\">:<\/span><\/h2>\n<p><span style=\"\\\"font-weight:\" 400;\\\">El objetivo del recinto fiscal y el recinto fiscalizado es el mismo: funcionar como los espacios que permitan el manejo, custodia, carga y descarga de mercanc\u00edas. Sin embargo, ambos tienen caracter\u00edsticas particulares que los distinguen y que, por lo tanto, es necesario esclarecer.\u00a0<\/span><\/p>\n<h2><b>\u00bfQu\u00e9 es un recinto fiscal?<\/b><\/h2>\n<p><span style=\"\\\"font-weight:\" 400;\\\">Un recinto fiscal es el espacio administrado, \u00fanica y exclusivamente, por autoridades aduaneras, en donde se realizan funciones de manejo, almacenaje, custodia; carga y descarga, fiscalizaci\u00f3n y despacho aduanero. Las bodegas en peque\u00f1os aeropuertos al interior del pa\u00eds, en donde arriban mercanc\u00edas del extranjero, son un claro ejemplo de un recinto fiscal.\u00a0<\/span><\/p>\n<h2><b>\u00bfQu\u00e9 es un recinto fiscalizado?<\/b><\/h2>\n<p><span style=\"\\\"font-weight:\" 400;\\\">Un recinto fiscalizado, a diferencia del recinto fiscal, es administrado por particulares con autorizaci\u00f3n del Servicio de Administraci\u00f3n Tributaria (SAT). El objetivo de estas concesiones es que los particulares presten los servicios de manejo, almacenaje y custodia de mercanc\u00edas, en inmuebles ubicados dentro de los recintos fiscales.\u00a0<\/span><\/p>\n<p><span style=\"\\\"font-weight:\" 400;\\\">Cualquier terminal donde se realicen maniobras de carga y descarga de contenedores que arriban al pa\u00eds del extranjero puede ser un recinto fiscalizado. Adem\u00e1s, estos pueden ser colindantes a recintos fiscales, recintos portuarios, aduanas mar\u00edtimas, fronterizas, o interiores de tr\u00e1fico ferroviario o a\u00e9reo.\u00a0<\/span><\/p>\n<h2><b>Recinto fiscalizado estrat\u00e9gico<\/b><span style=\"\\\"font-weight:\" 400;\\\">:\u00a0<\/span><\/h2>\n<p><span style=\"\\\"font-weight:\" 400;\\\">Por su parte, un recinto fiscalizado estrat\u00e9gico es, tambi\u00e9n, un espacio administrado por particulares por concesi\u00f3n del SAT. Brinda servicios de manejo, almacenaje y custodia de mercanc\u00edas.
